Banta. <br />Division Director <br />The second period (1990) water quality results for the Apex No. 2 Mine must be <br />received no later than October 12, 1990 to avoid a violation. Be sure the <br />results include the downstream P3M data. Please also submit the third quarter <br />pond inspection, and third quarter NPDES reporting form no later than <br />October 12, 1990. Please also be reminded that failure to file the monitoring <br />and inspection reports with the mine record collection in Oak Creek will <br />result in a violation. <br />This letter is sent so that we may avoid cumbersome enforcement procedures. <br />However, if future submittals are not received on time, we may or may not <br />issue a reminder prior to issuing a violation, Your cooperation in avoiding <br />violation situations would be greatly appreciated. <br />Sincerely, <br />/~. <br />-David A.
