• RESPONSE Continued (2.05.5) <br />Plans for enlargements, reduction in size, reconstruction or the <br />modification of dams or impoundments will be submitted to the <br />Division and will comply with the requirements of 4.05.9, except <br />where a modification is required to eliminate an emergency con- <br />dition constituting a hazard to public health, safety or the en- <br />vironment. <br />EXCERPT FROM THE LAW <br />(10) All sediment ponds, shall be examined for structural <br />weakness, erosion, and other hazardous conditions. <br />. (a) All dams and embankments meeting the criteria of <br />4.05.6(10) shall be routinely inspected by a <br />qualified registered professional engineer or by <br />someone under the supervision of a qualified pro- <br />fessional engineer in accordance with applicable <br />provisions of 4.05.6(11)(a). <br />(b) For sediment ponds that do not meet the criteria <br />of 4.05.6(10), the operator shall examine such <br />ponds and make quarterly reports to the Division <br />or at other intervals as approved by the Division. <br /> <br />
