• RESPONSE Continued (2.05.5) <br />EXCERPT FROM THE LAW (To Provide Clarity) <br />4.05.9 PERMANENT AND TEMPORARY IMPOUNDMENTS <br />(1) Permanent impoundments for beneficial use of stored water <br />may only be authorized in accordance with applicable state <br />law and upon the bases of the following demonstration: <br />(a) The quality of the impounded water shall be suitable on <br />a permanent basis for its intended use, and discharge <br />of water from the impoundment shall not degrade the <br />quality of ,receiving waters to less than the water <br />quality standards established pursuant to applicable <br />i , state and federal laws; <br />RESPONSE -- <br />~ It is anticipated that the quality of the water will be suitable <br />for watering stock. Data will be collected over the life of the <br />mine. From this information the quality of the water will be <br />assessed. <br />The discharge of water from the permanent stock ponds is not an- <br />ticipated to degrade the quality of receiving waters to less <br />than the water-quality standards established pursuant to appli- <br />cable state and federal laws. <br />• <br />
