• REVIEW QUESTION
2.05.5 POST-MINING LAND USES
At this time, it is unc ear whether the establishment of permanent stock
watering ponds is consistent with the post-mining land use. Additionally,
establishment of these ponds as permanent stock ponds has a direct effect
on downstream water rights. This proposal will, therefore, require a de-
cision by the State Engineers Office. The applicant must demonstrate with
a narrative, drawings, and any other available information that these
structures are in compliance with 4.05.9.
RESPONSE
The H-G Coal Company special use permit with Routt County states
that H-G Coal will develop water on the mine site at the con-
clusion of mining for the purpose of watering stock. (See at-
tached Special Use Permit.) Since grazing is a post-mining land
use, the establishment of permanent stock watering ponds is con-
sistent with the post-mining land use.
•
Water rights on ponds and s~Frings in the mine permit area have
been filed for, (see enclosed Water Rights Application).
•
