• REVIEW QUESTION <br />2.05.5 POST-MINING LAND USES <br />At this time, it is unc ear whether the establishment of permanent stock <br />watering ponds is consistent with the post-mining land use. Additionally, <br />establishment of these ponds as permanent stock ponds has a direct effect <br />on downstream water rights. This proposal will, therefore, require a de- <br />cision by the State Engineers Office. The applicant must demonstrate with <br />a narrative, drawings, and any other available information that these <br />structures are in compliance with 4.05.9. <br />RESPONSE <br />The H-G Coal Company special use permit with Routt County states <br />that H-G Coal will develop water on the mine site at the con- <br />clusion of mining for the purpose of watering stock. (See at- <br />tached Special Use Permit.) Since grazing is a post-mining land <br />use, the establishment of permanent stock watering ponds is con- <br />sistent with the post-mining land use. <br />• <br />Water rights on ponds and s~Frings in the mine permit area have <br />been filed for, (see enclosed Water Rights Application). <br />• <br />
