Hhen mining operations are concluded or following the termination <br /> of this lease, Lessee will completely restore all areas whereto strip <br /> mining has been engaged 1n., Such restoration shall Include replacement <br /> of overburden renaved by Lessee preparatory to strip mining operations and <br />' the reseeding of same with brome grass end intermediate wheat grass. <br />__ In ad dltton, Lessee shall comply with all governmental laws and regulations <br /> relating to strip mining operations and the restoration of ground, imposed <br /> by any state, federal or county governmental agency or authority. , <br /> 3. To pay all severance taxes imposed in connection with the mining <br /> of minerals from said lands and to pay all taxes which may be Imposed <br /> upon irt~provements Dlaced on said lands by Lessee. Hot to permit any liens <br /> to be imposed against said lands. <br /> 4. So long as it conducts mining operations to provide to Lesson at <br /> the tipple and without charge all the coal which Lessors need for their <br /> danestic use. <br /> 5. At all times to keep open and to do nothing which will plug up, <br />• the ditch which serves Lessors' lands. <br /> IT IS FURTHER MUTUALLY UNDERSTOOD AND AGREED: <br /> 1. That Lessee shall have six months following the termination <br /> of this lease within which to remove any improvements placed by Lessee <br /> on the leased premises, provided Lessee shall restore any damage occasioned . <br /> to said premises by virtue of sold removal. If such improvements are <br /> not removed within said six months period, such improvements shall forever <br /> become the property of Lessors as part of the realty. <br /> 2. If Lessee shall default in the payment of any rentals due Lessors <br /> or in the performance of any of the other covenants or agreements <br /> undertaken by it. Lessors may, glue Lessee a written notice setting forth, <br /> with particularity, the nature of Lessee's default or defaults and giving <br /> Lessee thirty days within which to cure such default. If Lessee shall fail <br /> or neglect to cure such default within such period, at the election of <br /> the Lessors, this lease may be terminated forthwith without further notice <br /> and, 1n such event, all of Lessee's rights hereunder or to the lands hereto <br />. described shall be extinguished. <br />-3- <br />
