C <br />shall have the right to copy such records, obtain audits, etc., at <br />Lessor's sole expense. Upon termination of this Lease, Lessee shall <br />• furnish Lessor copies of all such information within ninety (gD) <br />days of the date of such termination. During the term hereof, Lessee <br />' shall keep Lessor advised of its plans of operetions and exploration on <br />the Lease. <br />7. Surface Rights. To the extent that Lessor does own rights <br />to the surface, Lessor does grant to Lessee such rights but only such <br />rights. Lessee does hereby agree to indenmlfy and hold Lessor harmless <br />from all claims, costs and liability, by reason of damage to the surface <br />or otherwise by reason of Lessee's activities pursuant to this Lease, <br />including reasonable attorney's fees incurred to the defense of such <br />claims, costs, or liability. In addition, Lessee agrees to hold Lessor <br />harmless against all claims and demands of whatever kind or nature <br />nrlsing by reason of Lessee's occupancy of the Land or any by act <br />omission by Lessee, its agents or employees, in the conduct of Lessee's <br />rights under this Lease. If the suit shall be between Lessor and Lessee, <br />• the prevailing party shall be entitled to attorney's fees. Lessee <br />agrees to comply with all state and federal mining laws and regulations, <br />workmen's compensation laws and to carry such public liability and <br />property damage insurance 1n amounts to be determined by Lessee but <br />not less than 5100,000 - 5300,000 for liability and 510,000 for <br />property damage. <br />8. Joint Operations. Lessee shall have the right to operate <br />the Lend in connection with mining operations with other lands adjacent <br />thereto; provided, that the plan of mining shall adequately protect <br />Lessar in determining the source of coat mined from adjacent properties <br />end prior notice of removal thereof through the Land is given by Lessee. <br />9. Other Leases. Lessor specifically reserves the right to explore, <br />develop, and operate the Lends for minerals, including oil and gas, <br />other than coal, and to grant Leases therefor. Notwithstanding this <br />clause, operations under Leases of other minerals shall not be conducted <br />. without first obtaining the approval of Lessee hereunder es to location <br /> <br />-4- <br />
