LOng <br />Division Director <br />The Division has reviewed you 110 permit application for Permit # M-2000-046 and has the <br />following comments. <br />EXHIBIT "B" <br />The operator states that the operation will be designed in such a way that no water will dischazge <br />into the Hazd Stable Creek. However, the mining plan map shows part of the permit boundary to <br />include Hazd Stable Creek along the North East portion of the permit boundary. Are there plans <br />to mine the creek bed or divert the stream during mining ?Please explain. <br />EXHIBIT " C" <br />The operator states, anything other than the surface 6" to 8" of growth media is saleable product. <br />The SCS report states, soil material suitable for surface reclamation varied from 4 feet on the <br />South side of the azea, to a minimum of 6 inches or less on the West side of the azea. The 36 unit <br />( Fort Collins loam) would be the best unit to obtain topsoil from. Does the operator plan to <br />salvage all available topsoil ? <br />EXHIBIT "D" <br />Under the depth of overburden to be replaced, the operator states, overburden will be sold as <br />product when possible. Present estimates aze that 10" to l4 "may remain to be replaced during <br />reclamation. In order to properly calculate the financial warranty, the Division calculated an <br />average 12" of overburden to be spread over the entire affected area. The financial warranty <br />calculation is inclosed with this letter. <br />Please be advised that the application may be deemed inadequate, and your application may be <br />
