<br />• III IIIIII~IIIIIIIII ~ Permit No. 78-315 <br />HINED LAND RECLAMATION BOARD <br />Department of Natural Resources <br />13,13 Sherman Street, Room 723 Telephone: 839-3567 <br />Denver, Colorado 80203 <br />DEVELOPMENT AND ERTRACTION MINING PER:tIT <br />THIS PER.`lIT is.issued this 24 day of November, 1978 by the Mined Land <br />Reclamation Board, Department of Natural Resources, state of Colorado.. <br />W I T N E S S E T H <br />~EREpS~ Routt County desires to conduct a(n) open mi~•ng <br />operation, known as Red Rock Pit , for the purpose of extzactirig open <br />mined sand 6'gravel. and <br />'WHEREAS, on November 8 1978 Routt County "FILED,' an appli- <br />ca[ion, a reclamation plan and map, and the required fee, as required by law; and <br />WHEREAS, oa November 22 , 1978 , the Mined Land Reclamation Board approved . <br />Routt County's application and set bond; and <br />WHEREAS, on November 22 .1978 , the Mined Land Reclamation Hoard accepted surety <br />submitted by. Routt County and such date shall be considered the <br />dace bE issuance of Che permit and the anniversary date for all other purposes; and <br />r <br />WHEREAS, the titn0d Land Reclamation Hoard has made a finding, for the purposes <br />of issuing this permit, that: <br />1) the application complies with the requirements of the Colorado <br />:Lined Land Reclamation Act and all applicable local, state and <br />Federal lays; and, <br />2) the operation will not adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, except where there <br />is an agreeaenc ber~een the operator and the persons having an <br />interest in the structure that damage co the structure is co be <br />compensated Eor by the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />in conforpance with the requirements of C.R.S. 1919, 34-32-116, <br />as amended (1976 Sess. Laws H.B. 1065); and <br />WHEREAS, for the purposes of issu'_ng this permit, the operator has made <br />a satisfactory shoving to the Hoard that he will employ during and after his <br />open mining operations procedures reasonably designed to minimize as mucl <br />as practdcabLe the aisruption from tF.e open mining operations and vi.L ~ <br />provide Ear the rehabilitation of the affected land through Che rehabllitat•icn of plant <br />cover,'scil stability, eater.resources, and other measures appropriate t•o'the•••• <br />subsequent. beneficial use of such mined and reclaimed lands; and t4 at 1n <br />the event of. the Eailure of his proposed reclamation plan, he will take whatever <br />measures which may be necessary in order to assure the success of reclamation of <br />the lands affected by.his open mining operations.; and, <br />• WHEREAS, for the purposes of issuing this permit, a copy of the application <br />approved by the Mined Land Reclamation Board of the State of Colorado is attached <br />to Ch is permit and thereby becomes apart of the terms hereof. <br />NOW, THEREFORE, pursuant to the authority set forth in the Colorado :lined <br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1473, as amended, (1976 <br />Sess.
