Problems in the perimeter fence were observed 'in the southwest corner. Tear in
wire fabric and fence comer post eroded by corner of road adjacent to it.
An accumulation of sediments and aquatic plant growth was observed along the
south side of the pond and the two north corners. Several small trees have taken
root along the south bank.
The plywood cover over a concrete valve pit on the east side of the pond is not
sturdy and the fence is gone near the pit.
Comments this quarterly inspection include cease inflow and stabilize water level,
monitor hypalon lining, and replace valve pit Gd, repair southwest fence comer and clean
iron stain offhypalon lining.
To the best of my knowledge, based upon my professional expertise, the Fresh
Water Impoundment Pond No. 3 at the Southfield Mine is being maintained in
conformance with the prudent state-of--the-art of earthen embankment construction.
I hereby certify, based upon my Seld observations and professional investigations,
as detailed here above, that the Fresh Water Impoundment Pond No. 3 at Energy Fuels
Coal, Incorporated's Southfield Mine, located in Fremont County, Colorado, is being
maintained in compliance with the requirements and regulations of the Colorado Mined
Land Reclamation Division.
