The inspection was performed by
myself, John Effinger III, a registered professional engineer in the State of Colorado since
December, 1975. I have experience and knowledge in the design and construction of
dams, drainage control, hydrology and structures; including experience in portions of the
permitting process of coal mine facilities and permit compliance.
The purpose of this inspection and certi5cation was to check for structural
weakness, erosion, other hazardous conditions and identify required maintenance and to
satisfy the requirements of Rule 4.05.6 (13) of the Colorado Mined Land Reclamation
Board for Coal Mining. In addition to the on site inspection referenced above, actions
taken in preparing this certi5cation included review and discussion of applicable mine
maps and state regulations with yourself.
Said inspection was performed on a hot (90°), cloudy, Friday afternoon by myself.
Most of the site was traversed by hiking trips over, across and around the structure. The
following is a statement of my professional observations and conclusions from this
inspection:
The entire pond was examined for structural weakness, erosion, and other
hazardous conditions; At this inspection, as at previous inspections, a large crack
in the north dam wall was observed on top. The crack in the soil is about 1 inch
thick and ten to Sfteen feet long. The crack is in the south face of the top of the
dam, neaz the outlet structure.
The pond was dry and contained no water at the time of this inspection.
Tumbleweeds in outlet pipe are thick.
