~.• <br />D. Swiss Village, inc. shall have the right to produce, <br />store, transport and use all of the water produced by the well <br />on the subject property, which well is 525 feet North of the <br />East-West centerline of Section 15, and 2,900 feet East of the <br />Z•lest line of said Section, together with an easement for repair <br />and maintenance of the water line to the restaurant premises <br />now known as Old Heidelberg Inn. The license and easement for <br />production, storage, transportation and ue of all of the water <br />from said well shall be irrevocable until such time as an <br />equally satisfactory source of domestic water becomes a~~ailable. <br />E. Swiss Village, Inc. shall have an easement for ingress <br />and egress to the restaurant known as the Old Heidelberg Inn, <br />defined by an existing road from U. S. 40 to the rear boundary <br />of the property of Swiss Village, Inc., said easement .to .terminate <br />upon the realignment of the southern entrance of the sa:Ld property. <br />F. The Grantor shall reserve the right to receive royalties <br />under the present mining lease of the subject property, however, <br />said royalties shall be reduced to two and a half cents (2~p) <br />per ton after payment, by the lessee, of royalties entitling <br />said Lessee to conveyance of 80 acres in the W/2 NW/4 oi: Section <br />15, Twp. 4 South, Range 70 west of the 6th P.M. as provided <br />in said lease. Said reduced royalty shall continue to k,e paid <br />upon the next 3,570,000 tons of aggregate removed from t:he <br />premises, and thereafter, so long as the lessee maintains the <br />mining and sale of aggregates on any of the property said lessee <br />will pay royalties at the rate of seven and one-half cents (7~G) <br />per ton of aggregate removed from the premises. <br />hand sold <br />EXECUTED this 15th day of April, 1974. <br />~~ <br />Gail H.
