page 796, said coal interest ~-ras assigned to Union Pacific Lasnd Resources
Corporation, a ~IJtah corporation.
C. Right o,f.Y7ay Easement granted to The PQountain States Telephone and
Telegraph Company by instrument recorded April 7, 1971 in Bo~~k 2250, page 191,
to-trit: A strip of land Five (5') feet on each side of a centerline describecl
as follows: Beginning at a point which bears North 57°57'05' West frrn~ the
East Quarter corner of Section 15, Township 4 South, Range 70 west of the 6th
Principal Meridian a distance of 2110.41 feet; thence North :i2°42'30"idest a
distance of 634.07 feet to a point which bears North 47°57'5:?" West a distance
or 2596.20 feet from the said East Quarter corner of said Section 15.
D. Swiss Village, Inc. shall have the right to produce, si:ore, transport,
and use all of the water produced by the well on the subject property, which
well is 525 feet Nort}~ of the East-West centerline of Sectio:z 15, an3 2,900
feet East of the West line of said Section, together with an easement for
repair and maintenance of the water line to the restaurant premises now known
as Old Heidelberg Inn. The license and easement for production, storage,
transportation and use of all of the water from said well shall be irrevo-
cable until such time as an equally satisfactory source of dcxnestic water
becanes available.
E. Swiss Village, Inc. shall have an easement for ingress and egress
to the restaurant known as the Old Heidelberg Inn defined by an existing
road from U. S. 40 to the rear boundary of the property of Swiss Village, Inc.
said easement to terminate upon the realignment of the southern entrance
of the said property.
F. The Estate of J. Bryan Bennett has reserved the right +.o receive I
royalties under the present mining lease of the subject property, however,
said royalties shall be redeuced to two and a half cents (2z'%) per ton
after payment, by the lessee, of royalties entitling said Le:~see to conveyance
of 80 acres in the D7/2 NT,7/4 of Section 15, Twp. 4 South, Ran<3e 70 West of
the 6th P.PY. as provided in said lease. Said reduced royalty shall continue
to be paid upon the enxt 3,570,000 tons of aggregate removed from the
premises, and thereafter, so long as the lessee maintains the mining and ~~
sale of aggregates on any of the property said lessee will pray royalties
at the rate of seven and one-half cents (7~Z~) per ton of aggregate removed and
sold from the prenises.
