-2- <br />Condition "D" <br />By June 1, 1990 the operator will submit to the Division all information <br />necessary for the Division to render a decision on the permit renewal. <br />As of June 1, 1990, the operator had submitted a portion, but not all <br />necessary information as specified in the November 2, 1989 Findings and <br />Recommendation for Denial Decision Document, and the January 10, 1989 adequacy <br />review letter. In addition to bond related information addressed above, the <br />following information had not been submitted: <br />Topsoil Salvage and Replacement <br />Topsoil balance projections need to be updated based on volumes salvaged <br />to date. Division inspections indicate that substantially more topsoil <br />was salvaged than was originally projected. <br />- Discrepancies regarding proposed disturbance acreage and topsoil <br />replacement depths need to be resolved. This and the previous concern <br />affect both the magnitude of the worst case disturbance for bonding <br />purposes as well as the appropriate topsoil replacement depth. <br />Specific concerns and informational deficiencies regarding topsoil salvage and <br />replacement which need to be resolved before a permit renewal could be issued <br />were included as items 14, 15, and 16 of the Division's January 10, 1989 <br />adequacy letter. <br />Operation Description <br />Status of the operation with respect to phase of pit and fill <br />development, facilities construction and projected timeframes needs to be <br />updated. Timeframes as originally projected were disrupted by the long <br />period of inactivity. The permit application text does not accurately <br />reflect the current status of the operation. <br />This concern is addressed in item 25 of the January 10, 1989 adequacy letter. <br />Backfilling and Gradin <br />In order to verify pit and fill volumes for bonding purposes, as well as <br />to document the feasibility of the final reclamation configuration, a <br />topographic survey and swell factor determination as specified in the <br />original permit application and Findings of Compliance document will need <br />to be submitted. <br />This concern was included as item 28 of the Division's January 10, 1989 <br />adequacy letter. <br />
