Our file 1/77-195, 1177-1 <br />U77-197. <br />Dear Mr. Baker: <br />Thank you far your letter of January 31, 1978. The delay has been caused <br />by the resignation of Mr. Colbert and difficulties encountered in assum- <br />ing all of his previous responsibilities plus my normal duties. Hopefully, <br />we can expedite your applications in the near future. <br />I will send your letter of credit to our Assistant Attorney General for <br />review as adequacy of bond. You must understand that this bond was no[ <br />for the "permits which appear to have not been brought before the Board <br />yet, but as surety under Che compliance plan. Your applications are still <br />pending. <br />'''At the Board's February meeting, it was determined that all those operators <br />who failed to fully comply with the deadlines of the compliance plan must <br />show cause at the March Board meeting why a Cease and Desist Order not be <br />issued. It appears to me that the fact that only your bond was late and <br />that you met all other deadlines is good cause for not having a Cease and <br />Desist Order issued. The Board has already extended one compliance plan, <br />but they wish each operator to be judged on the merits of his own case <br />and circutnstancea. <br />Prior to the March Board meeting, I intend to become familiar with your <br />three applications and the history of your file so that I can answer any <br />of -the Board's questions. At this point my recommendation to the Board <br />would be to accept and to extend your compliance plan because i[ appears to <br />me Hart Kok has made a good faith effort to comply with the law. <br />If you have any questions, please call. <br />Sincerely, <br />Mark A.
