Harry Posey <br />~RE: Water~ality Sam~rlina <br />Permit No. M-1999-034, Amendment No. 1 <br />Aggregate Industries - WRC, Inc. <br />Dear Mr. Posey: <br />On October 22, 2003, nearly one year ago, we sent a letter to the Division of Minerals and <br />Geology regarding water quality sampling under the above referenced mining permit. In that <br />letter we discussed: <br />1. Condition No. 1 of the MLRB order requiring the operator to submit a monitoring plan to <br />the Division for approval; <br />2. The requirements that such a monitoring plan address the specific chemical <br />chazacteristics of the chemical of concern, diisopropylmethlyphosphonate, DIMP; <br />3. The errors and deficiencies of the Molen & Associates September 18, 2003 report; <br />4. The well completion details of our ircigation well, permit no. 32883, and issues of proper <br />well purging; <br />5. The lack of documentation and adherence to the referenced Colorado Department of <br />Public Health and Environment monitoring well sampling guidance document; and <br />6. The representativeness and validity of the water quality sample that was collected. <br />A copy of that original correspondence is enclosed for your reference. To date, we have received <br />no official response from the Division regarding the issues and concerns we raised. We have <br />been a party to recent hearings the applicant has made to the Colorado Division of Water <br />Resources and the Adams County Planning Commission. It is clear to us that Aggregate <br />Industries-WCR, Inc. is near the end of its application processes with other regulatory agencies <br />and may commence mining on the Jeronimus property soon.
