PART II <br />Page 39 <br />Permit No. COG-600000 <br />B. RESPONSIBILITIES <br />5. Modification. Suspension. Revocation. or Termination of Permiu By the Division <br />c. (cont.) <br />(3) Requiremenu of Section 6.16.0 of the Regulations for dte State Dischazge Permit <br />System have been met, and <br />(4) Req~~+*ri^a^u of public notice have been met. <br />d. Permit modification (except for minor modifications), terminazion or revocation and <br />reissuance actions shall be subject to the requiremenu of Sections 6.6.2, 6.6.3, 6.7.0, 6.8.0 <br />and 6.16.0 of the Regulations for the State Discharge Permit System. The Division shall act <br />on a permit modificazion requut, other than minor modificazions requesu, within 180 days <br />of receipt thereof. Except for minor modifications, the terms of the existing permit govern <br />and ate enforceable until the newly issued permit is formally modified or revoked and <br />reissued following public notice. <br />e. Upon consent by the permittee, the Division may make minor permit modifications without <br />following the requiretttenu of Sections 6.6.2, 6.6.3, 6.8.0, and 6.16.0 of the Regulations for <br />the State Aischarge Permit System. Minor modifications to permiu are limited to: <br />(1) Correcting typographical errors: or <br />(2) Increasing the frequency of monitoring or reporting by the permittee; or <br />(3) Changing an interim daze in a schedule of compliance, provided the new date of <br />compliance is ao[ mote than 120 days after the daze specific in the existing permit <br />and does not interfere with attaip±ne~+t of the final compliance date requirement; or <br />(4) Allowing for a transfer in ownership or operational control of a facility where the <br />Divisiop determines that no other change in the permit is necessary, provided that <br />a writtm agreement containing .a specific daze for transfer of permit responsibility, <br />coverage and liability betwern the current aced new permittees has been submitted to <br />the Division; or <br />(5) Changing the construction schedule for a discharger which is a new source, but no <br />such change shall affect a discharger's obligation to have all pollution control <br />equipment installed and in operation prior to discharge; or <br />(6) Deleting a point source outfall whep the discharge fmm that outfall is terminated and <br />does not result in dischazge of pollutants from other outfalls except is accordance <br />with permit limiu. <br />f. When a permit is modified, only the conditions subject to modification are reopwed. If a <br />permit is revoked and reissued, the entire permit is reopened and subject to revision and the <br />permit is reissued for a new term. <br />g. The filing of a request by the permittee for a permit modification, revocation and reissuance <br />or termination does not stay any permit condition. <br />h. All permit modificaziotu and reissuances are subject to the antibacksliding provisions set forth <br />in 6.11.0 (5) through (9). <br />
