Long <br />Division Director <br />Upon your request, I have reviewed the stipulation responses <br />submitted by Mr. Robert Larson of ZMK and conclude that only <br />Stipulation No. 3 has been completed to our satisfaction. <br />Stipulation No. 2 has been partially completed; however, ZMK has <br />not provided the channel profile expected during final <br />reclamation. Therefore, I suggest that we require a reclamation <br />channel slope of 1%, the same as that which occurs now. The <br />remaining stipulation nos. 1, 4, 5 and 6 have not been completed <br />by ZMK. <br />I suggest that we notify Mr. Larson that failure to achieve a <br />1% slope upon completion of mining and reclamation will result in <br />either aggradation or degradation of the stream bed, neither of <br />which are desirable. If excessive aggradation or degradation <br />occurs, there will be offsite impacts. <br />/ern <br />M:\oss\ern\m91146.tas <br />
