Long
Division Director
Upon your request, I have reviewed the stipulation responses
submitted by Mr. Robert Larson of ZMK and conclude that only
Stipulation No. 3 has been completed to our satisfaction.
Stipulation No. 2 has been partially completed; however, ZMK has
not provided the channel profile expected during final
reclamation. Therefore, I suggest that we require a reclamation
channel slope of 1%, the same as that which occurs now. The
remaining stipulation nos. 1, 4, 5 and 6 have not been completed
by ZMK.
I suggest that we notify Mr. Larson that failure to achieve a
1% slope upon completion of mining and reclamation will result in
either aggradation or degradation of the stream bed, neither of
which are desirable. If excessive aggradation or degradation
occurs, there will be offsite impacts.
/ern
M:\oss\ern\m91146.tas
