We are always surprised and grateful when we <br />receive this kind of response unfortunately that has not happened <br />in this matter. <br />Nevertheless, we are required to answer the questions posed by <br />the regulations. We enclose a revised Exhibit H. <br />The use of this private property for extraction of the natural <br />resource is apparently not in the best interest of the mule deer <br />community. The deer use the site for grazing in winter. We <br />regret the necessity of this disturbance. However, thousands of <br />hunting licenses are issued every year by the Division of <br />Wildlife, and that practice, too, must be considered detrimental <br />deer population. <br />Exhibit L - Reclamation Cost <br />2. The Division has maintained for years that the costs to be <br />used are not those of the operator but rather the costs that <br />would be incurred by the State. You have successfully argued <br />before the Board that the respreading cost will vary between $0.57 <br />and $1.05 per/yard for an average distance of less than 50U <br />yards. We have specified that soil stockpiles will be located <br />within 500 feet of areas to be respread. Since the State is <br />required to return bond money not used for reclamation, we assume <br />the Division will realize it is not their money to throw away end <br />will seek a bid for the minimum price your table reflects. We <br />used $.86 per/yard in our original estimate, but now it appears <br />that we have overestimated this cost. It appears that a low bid <br />in the amount of $.60 per yard might be expected by the Division. <br />With this new figure, the first line of our per-acre cost <br />estimates should read: "Respread soil and/or spoil (1 acre x <br />43560 sq ft/ac x 1 ft)/27 tuft/yd=1614 yds/ac x $0.60 = $968.40 <br />per acre" and the TOTAL PER ACRE TO REVEGETATE BENCH AREAS should <br />be $1,351.20 <br />Assuming that you are right and the Board will someday approve a <br />cost for grading and shaping that is the same as that used by the <br />coal section, we have recalculated the grading and shaping cost at <br />$70.00 per hour for four hours to be a total of $280.00 per acre. <br />Thus in the first year the cost would be: <br />Revegetation bench area, 2.32 ac @ $1351. <br />Floor and road area, 2.47 ac @ $280.00 <br />Total <br />20 = $3134.78 <br />= 691.60 <br />$3,826.38 <br />3 <br />
