Exhibit D - Mining Plan <br />2. Please find enclosed revised copies of Map Exhibits C, D-1, F <br />and J-1. These maps now reflect the results of the recently <br />completed certified boundary survey. You will note this is <br />essentially the same outline as originally submitted. The <br />exterior lines have been corrected for irregularities in this <br />particular section. The survey indicates these section lines vary <br />from the norm. Also enclosed is a copy of the revised legal <br />description. Total acreage has decreased from 130+/- acres to <br />approximately 116.48+/- acres. <br />As to your question about the affect on the drainage system, it <br />was our original thought that if we were to use the existing jeep <br />trail, we could cross the ravine at almost any place without <br />hurting existing conditions because the ravine is solid rock and <br />could hardly be damaged by our traffic. The new survey makes it <br />obvious that it is more desirable for us to build a completely <br />new access road at the outset. We have therefore abandoned any <br />intent to use the old jeep trail or cross the ravine. The access <br />road will start at U.S. 6 on the east side of the intermittent <br />creek and run to the northeast, as shown on the enclosed Map <br />Exhibit D-1. The operator expects the access road to be 35 feet <br />wide or less. <br />9. Thank you for clarifying your question. The statutes and <br />regulations you quote both refer to protecting the area outside <br />the affected land from slides or other damage, while you refer to <br />possible bench stability problems.
