The
agreement called for "within six months after the effective date of this agreement Coal
Partners shall have and be continuing multiple entry systems into the Anchor Tresner Unit
for the purpose of obtaining production of coal from the Anchor Tresner Unit". The six
month period would end June 30, 1977.
On February 24, 1977, we submitted a mine plan to the Area Supervisor, U. S.
Department of the Interior Geological Survey.
On June 17, 1977, in a further letter to the Area Supervisor we stated, "We have
commenced roads and preparation of outcrop entry sites on the Anchor and Cameo seams
on the fee land we control as per our mine plan submitted February 24, 1977."
The roads and benches were prepared and entries commenced during the six month
period ending June 30, 1977; therefore the benches and so-called highwalls were in existence
prior to August 3, 1977.
We should also like to emphas¢e that to destroy the remaining Cameo bench and
access road would severely handicap, if not completely destroy, our ability to proceed with
• the Anchor Tresner Coal Unit. It would also be against the wishes of the owners of the fee
land containing the Cameo bench.
7//~+~7Z
61c
