Simpson, Deputy State Engineer ~~ <br />SUBJECT: David Goss, Goss Sand & Gravel, M-85-140, Sec. 7, T13S, R62W <br />As requested, we have reviewed the above referenced <br />to mine sand and gravel, 6 miles north of Ellicott, <br />County. Aground water lake with a surface area of <br />on the 9.9 acre tract. Mr. Goss plans to use water <br />mining operation. Otherwise, Mr. Goss will be <br />in violation of C.R.S. 37-90-107. Since the gravel pit is located in the <br />over-appropriated Upper Black Squirrel Creek Designated Basin, the well permit <br />for this evaporation of ground water could not be obtained until an <br />application for use of ground water has been approved by the Ground Water <br />Commission. <br />Mr. Goss claims to have 420 AF of transportable water rights in the Upper <br />Black Squirrel Creek Designated Basin. It may be possible for Mr. Goss to use <br />some of these rights in his application to the Ground Water Commission. <br />Until Mr. Goss obtains a well permit for the gravel pit, we cannot recommend <br />approval of this application.
