As requested, we have reviewed the above referenced
to mine sand and gravel, 6 miles north of Ellicott,

Since the applicant is planning to expose ground water and put it to
beneficial use, a well permit would be required. Otherwise, Mr. Goss will be
in violation of C.R.S. 37-90-107. Since the gravel pit is located in the
over-appropriated Upper Black Squirrel Creek Designated Basin, the well permit
for this evaporation of ground water could not be obtained until an
application for use of ground water has been approved by the Ground Water
Commission.
Mr. Goss claims to have 420 AF of transportable water rights in the Upper
Black Squirrel Creek Designated Basin. It may be possible for Mr. Goss to use
some of these rights in his application to the Ground Water Commission.
Until Mr. Goss obtains a well permit for the gravel pit, we cannot recommend
approval of this application. Further, if our Water Commissioner determines
that ground water is being exposed without a well permit, we will order Goss
Sand & Gravel to cease operations.
