DEPARTMEN • NATURAL RE III IIIIIIIIIIIIIIII •
David H. Getches, Executive Director
MINED LAND RECLAMATION DIVISION
DAVID C. SHELTON, Director
Richard D. Lamm
Governor
January 17, 1985
Mr. Gib Rindahl
Rindahl & Associates
2305 South Syracuse Way
Suite 217
Denver, Colorado 80231
Re: C. Ryan & Son (Leyden P:~), File No. 83-139
Dear Mr. Rindahl:
We have reviewed the above referenced permit application for adequacy with the
Minerals law and promulgated rules and regulations. This review has taken
into consideration not only this application but also Mike Stanton's letter of
August 30, 1983 and the reply letter of December 14, 1983 by Jay Silvernale.
Thank-you and Paul (I do not remember his last name) for your time in
assisting in the inspection of this site of January 15, 1985. This inspection
made the review of the application that much easier,
As specified in an earlier correspondence, the Board is scheduled to consider
this application at the February 27-28, 1985 meeting. Please respond to the
following items by February 15, 1985 to allow for Division review.
Exhibit C - Maps
~~ Rule 1.56(5) discusses mining operations adversely affecting man-made
structures located within 200 feet of the operations. Sheet 4 of 7 depicts
~$~tn mining operations coming within 100 feet of the water well and power poles.
Also, the last sentence on page 8 discusses relocating the water well
Q~'~~ pipeline. Because of these activities, the Division believes agreements
pursuant to this rule are needed from Public Service Company for their water
well and line, and from the owner(s) of the two power lines.
L-9 As we discussed in the field, if there is a change in plant location or mining
~ sequence due to County concerns, please submit updated maps.
Exhibit D - Mining Plan
The Division believes staking the permit boundary would be very beneficial to
the operator so that all equipment operators are aware of these boundaries
aV~ since there are no natural markers. Is this acceptable to the operator? If
not, please clarify how the operator will insure the operations stay within
the permit boundaries.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. (303) 866-3567
