used in these areas will favor the establishment and growth of these <br />species. Once again it is emphatically stated that the diversity goal given <br />in this paragraph for previously disturbed areas reclaimed with substitute <br />soil reconstruction materials will not be considered as a standard or <br />requirement for phase III revegetation bond release. Rather, the diversity <br />goal is voluntarily included by P&M in this document, because it provides a <br />benchmark for reclamation of these previously disturbed lands. <br />4.4.2.3 RiBariaa Standards <br />Initially two riparian areas were anticipated to be affected by <br />mining operations under this permit including the existing office and <br />tipple access road corridor crossing over Oak Creek, and the proposed water <br />withdrawal point on Trout Creek. The access road crossing over Oak Creek <br />has been designated as a permanent road for the post mining land use. <br />Therefore, a revegetation standard for this riparian site is no longer <br />required. The water withdrawal point on Trout Creek was reevaluated by mine <br />and Army Corps of Engineer personnel during the summer of 1990. Based on <br />that site visit the Trout Creek water withdrawal point was not disturbed, <br />so a revegetation standard for this riparian site is no longer required. <br />The remainder of the area associated with the existing lower office <br />is not in a riparian vegetation community. However, the area was disturbed <br />by mining before the 1980 regulatory program became effective. Therefore, <br />this previously disturbed area, like previously disturbed acreage on West <br />Ridge, is subject to the requirements of Rule 4.15.10 fro the purposes of <br />establishing revegetation standards. <br />6.4.2.4 Co~mnercial Land Use Standards <br />Commercial post mining land use was approved in Technical Revision <br />No. 37 for the former conveyor corridor, the Goat Trail, and part of the <br />lower facility area. Although these areas are subject to the revegetation <br />success criteria of Rule 4.15.10(2), a conflict apparently exists between <br />these standards for the 3.3 acres of gravel pad and Routt County standards. <br />If that inequity cannot be overcome this 3.3 acre area will be subject to <br />the 47~ cover standard for facilities areas. <br />TR-43 4.4-6 May 12, 2004 <br />
