SCHEDULE OF COMPLIANCE <br />The permittee shall achieve compiiance with the effluent limitations in Part A <br />for copper, lead and uranium, effective May 16, 1982, in accordant: with the <br />following schedule of compliance. <br />a. January 15, 1982 <br />The permittee shall submit to the Division a preliminary plan [o achieve <br />compliance with effluent limitations for eadmiam, copper, lead and uranium. <br />This report shall also include design plans and specifications for retention <br />ponds associated with the new treatment facilities. Retention ponds <br />receiving backwash waters, =nireated mine water, sludges etc. ~~hall be lined <br />non-discharging structures (permeabilities less than 10-6 cm/s<:c) receiving <br />no external runoff, but capabable of retaining [he vclume of water from a <br />100-year 2L-hour precipitation event falling on the structures and be <br />located above the 100-year flood plain of Ralston Creek. Plan~~ and <br />specifications for the retention ponds shall be subject to Div sion approval <br />prior to const.^uction. <br />b. February 15, 19P2 <br />The Division shall review the preliminary plan submitted by the permittee <br />and respond with comments. <br />c. Acril 15, 1982 <br />The permittee shall submit an update report on progress being Wade to comply <br />with the effluent limitations. This reoo:•t shall contain any eidjustments <br />[o the construction and implementation schedule .t hat have occurred. Progress <br />toward meeting the May lo, 1982 deadline should be covered. <br />d. May 1$, 1982 <br />The permittee shall achieve compliance with effluent limitations for <br />copper, lead and uranium as shown in Part A, page j, of the permit. <br />2. No lacer than 14-calendar days following a date identified in the eibove <br />schedule of compliance, the permittee shall submit either a report of progress <br />or, in the case of specific actions being required by identified dates, a <br />written notice of compliance or noncompliance. In the latter case, the <br />notice, shall include the cause of noncompliance, any remedial actions <br />taken, and the probability of meeting [he next scheduled requirement. <br />W r ~i <br />j. The Division ~a'+i consider a change in [he schedule of compliance if the Water <br />Qualit•! Control Commission grants a change of the temporary modifications on <br />Ralston Creek. <br />
