Simpson, P.E.
State Engineer
We have reviewed your letter of March 21, 2005, requesting renewal of the above referenced substitute
water supply plan to cover depletions caused by an existing mining operation. The required fee of $217,00 for
the renewal of this substitute supply plan has been submitted. The original supply plan was approved on March
25, 1994 and it was most recently renewed on March 25, 2004.
The anticipated net depletion for this plan is 120.2 acre-feet peryear, which includes evaporation from
up to 38.9 acres of ground water exposed after December 31,1980. According to the information submitted,
6 acres of ground waterwere exposed within the reclamation permit boundary prior to January 1, 1981. No
dewatering is provided or sought under this plan.
You have provided a monthly breakdown of the annual depletions totaling 113.8 acre-feet of
evaporative loss, 2 acre-feet of water used and consumed for dust control, 4.4 acre-feet of water lostwith the
mined product. No phreatophyte credit has been applied to this plan. The Geisert Pit is located less than 100
feetfrom the Cache La Poudre River and instantaneous depletions to the riversystem are assumed. Permit no.
50425-F was issued for the gravel pit pond (Geisert Pit) on August 19, 1998 and this permit remains valid.
The source of replacement water to be used for this plan is a lease of 120.2 acre-feet of reusable
effluent from the City of Greeley. Weld County has a perpetual lease with the City of Greeley for the right to
use up to 300 acre-feet per year of the Greeley's reusable effluent. A copy of the lease agreement with the
City of Greeley for 120.2 acre-feet of fully consumable effluent from Greeley's wastewater treatment plant to
be used at the Geisert Pitwas submitted to this office with this renewal request. The monthly depletions and
replacement requirements are found on the attached Table I.
I hereby approve the proposed substitute water supply plan in accordance with §37-90-137(11),
C.R.S., subject to the following conditions:
1. Unless otherwise revoked or modified, this plan shall be valid for the period of April 1, 2005 through
March 31, 2006. though March 31, 2006. If this plan will not be made absolute by a water court action
by the plan's expiration date, a renewal request must be submitted to this office with the statutory fee
(currently $217) no later than February 15, 2006.
