<br />AGREEMENT TO DEVELOP AND PURCHASE
<br />ROAD AGGREGATES
<br />THIS AGREEMENT made and entered into this 1st day of
<br />June , 1989, by and between Lavena E. Saunders, 22195 County
<br />Road P, Cortez, Colorado 81321, Mona A. Rogers, 20767 County Road S,
<br />Cortez, Colorado 81321 and Nola K. Welsh, 2537 Pearl Street, Boulder,
<br />Colorado 80302, hereinafter referred to as OWNER, and James J. Goode,
<br />d/b/a Blasting & Mining, Inc., P. 0. Box 656, Cortez, Colorado 81321,
<br />hereinafter referred to as BLASTING.
<br />WITNESSETH THAT
<br />WHEREAS, the OWNER owns the following described property:
<br />(1) That portion of property described in Deed recorded in Book 540
<br />at page 178 of official records of Montezuma County described more
<br />particularly as follows:
<br />Lot 3 and the North Half of Lot 4 of Section 18, Township 37 North,
<br />Range 14 West, N.M.P.M., County of Montezuma, State of Colorado.
<br />Together with the Northeast Quarter of the Southeast Quarter of the
<br />Southeast Quarter of Section 13, Township 37 North, Range 15 West,
<br />N.M.P.M., County of Montezuma, State of Colorado (hereinafter referred
<br />to as Parcel A).
<br />(2) The East Half of the Northwest Quarter of Section 13, Township 37
<br />North, Range 15 West, N.M.P.M., County of Montezuma, State of Colorado
<br />(hereinafter referred to as Parcel B).
<br />See map attached here to as Exhibit.
<br />AND WHEREAS, OWNER and BLASTING hereto desire to enter into this
<br />Agreement, the lease and rental of the above described property to
<br />BLASTING for the purpose of obtaining road aggregate from said land
<br />which shall be referred to as Gardner Pit #2, on the terms and
<br />co:~ditions as hereinafter set forth;
<br />NOW THEREFORE, in consideration of the mutual promises and
<br />covenants hereinafter contained, it is agreed as follows:
<br />OWNER grants to BLASTING the exclusive right to purchase, process
<br />and remove construction materials including but not limited to sand,
<br />gravel, concrete aggregate, base course, plant mix, aggregate and top
