If there are any measurements outside of the permit condition values (to be determined from baseline <br />monitoring), DMG will be notified within five (S) working days, and the first verification sample for the <br />indicator parameter that is outside of the permit condition value will be taken within two weeks. <br />If that verification sample also lies outside the permit condition value, a second verification sample will <br />be taken within two weeks after the first verification sample. If either verification sample is within the permit <br />condition values, the applicant will be judged to be in compliance. <br />If both samples are outside the permit condition value, DMG will be notified within five (5) working <br />days of receipt of the second verification sample results. Upon notification that both samples lie outside of the <br />permit condition value, DMG may notice the applicant of a possible violation of that condition of the permit. If <br />either sample is within the permit condition values, then the sampling will revert to the previously determined <br />sampling frequency. <br />Groundwater samples must be collected and baseline data assembled by an independent consultant <br />approved by the Division. The results of each quarter's sampling shall be submitted to the DMG within fifteen <br />(15) business days of the applicants receipt of each quarter's sampling results. <br />Upon beginning its mining operations, the applicant must report all groundwater sampling results <br />pursuant to the sampling frequency established by the Division. The Division will a-mail or send hard copy <br />results to interested parties on request. <br />The operator will submit a noxious weed management plan that will be prepared in consultation with <br />the local weed control district or noxious weed management authority. This plan must be submitted and <br />approved by the Division prior to any disturbance occurring on the site (except for surveying/testing and water <br />resource development), including mining and construction of any portion of the facility, and should generally <br />follow the principles outlined in the permit application, but must contain at a minimum the following elements: <br />A) A complete list of the target species that will be monitored and controlled; <br />B) Methods of control that will be employed to treat occurrences of target species; <br />C) Treatment windows tied to the various control methods that maybe utilized; and <br />D) A monitoring plan that will ensure that treated areas receive follow-up site inspections and secondary <br />treatment as necessary, and that [he remainder of the site is being monitored on a regular basis for early <br />detection and treatment, <br />C nnditinn #3: Magnf the Permit Area <br />The applicant will submit a single map clearly illustrating the extent of the proposed affected or <br />disturbed area within the boundaries of the permitted area. This should include all areas ancillary to the <br />development of the Phase I mining area, including but not limited to, roads, rail lines, ponds, topsoil stockpile <br />locations, plant development areas, surface water control structures, pit development, etc. <br />Condition #4: Hazardn ~s Materials Snills <br />A reportable spill is a spill of any toxic or hazardous substance (including spills of petroleum products) <br />within the permit area reportable to any division of the Colorado Department of Public Health and the <br />Environment, the National Response Center, the Colorado Emergency Planning Commission, a local emergency <br />planning commission, a local emergency planning committee, or the State Oil Inspector. <br />The operator shall notify the Division of a reportable spill within the pemtit area using-the same <br />timeframe required by the permit, license, notice, act, rule or regulation governing the reporting of the spill to <br />the appropriate agency. Notice of a reportable spill shall be faxed to: Minerals Program Supervisor, Division <br />of Minerals and Geology, FAX (303 832-8106).
