S-1 <br />Glenwood Springs, CO 81601-4272 <br />Re: 4th quarter 2002 Sediment Pond Report Review <br />Rimrock Strip Mine (Permit No. C-89-074) <br />Dear Mr. Johns: <br />The Division of Minerals and Geology has reviewed the sediment pond report for the 4`s quarter 2002 <br />submitted by Greg Lewicki and Associates for the Rimrock mine. <br />The report complies with the requirements of Rule 4.05.6(13) for inspection ofsediment ponds at coal <br />mining sites. Generally, the pond holds water only for limited periods after storm runoff events. <br />Adequate sediment and water storage capacity, spillway function, and embankment stability was noted. <br />Mr. Lewicki noted no remazkable observations. Based on our independent observations during field <br />inspection we concur with the observations as noted. <br />We have no questions regarding this report.
