14. Plan and agreement will be updated annually so that new <br /> techniques can be utilized as they are produced or found. <br /> 15. Operator will furnish the Land Reclamation Board a <br /> performance bond in the amount of $ 15,000.00 to insure that the <br /> work required herein will be accomplished. <br /> 16. If operator plans to discharge into a waterway, then a <br /> permit to discharge into same will be obtained from the Colorado <br /> Water Quality Control Commission. <br /> 17. Operator will monitor water wells in the vicinity of <br /> said operation to observe levels of said wells and will arrange for a <br /> pure water supply for the users or owners of wells affected by any <br /> drawdown of the water table as a result of this operation. <br /> 18. Operator will control erosion on or along haul roads by <br /> the use of drainage ditches, culvert:; or check &ms. <br /> 19. Natural drainways or drainways constructed to alleviate <br /> flood conditions in the area shall be kept free from overburden, stock- <br /> piles and topsoil. <br /> 20. Operator will obtain permission from the local county <br /> authorities before using water from any waterway, to prevent usurping <br /> any adjudicated water rights. <br /> 21. Trailers and/or buildings used for office, storage, and <br /> maintenance shall meet local zoning regulations. <br /> 22. Special use or other forms of permits shall be obtained <br /> from the county agency authorized to grant such permits. <br /> 23. Nothing in this agreement shall subrogate the operators <br /> responsibility for compliance with local county zoning requirements. <br /> If any of the terms, conditions and requirements of this <br /> agreement are violated at any time during the period of this agreement, <br /> the Land Reclamation Board may at their sole discretion close the <br /> mining operation until satisfactory arrangements have been made to <br /> bring the operation into compliance with this agreement.
