As an agent for operators directly Involved (n <br />exploration activity and permit applications petitioner la directly affected <br />by the controversy. <br />C.R.S.:34-32.6 -113 requtras that a notice of Intent ,fee, restoration plan, <br />and financial warranty be filed with the Mined Land Reclamation board <br />before, conducting "exploration" surface disturbance activities In the <br />course of prospecting for mineral construction materiels. <br />Prior ~ ~erslons of C.R.S. 34 -Article 32-5 (I.e., C.R,S. 34-92) made <br />provls? ~n for an exemption from the definition of the term "exploration ", <br />such that an exploration surface disturbance of less than 1600 square feet <br />(no m~ +re than two such disturbances per acre) was exempt from the <br />definition and notice requirement. Both the current and the prior "Rules <br />and Regulations of the Colorado Mined tend Reclamation Board" (Rule 1.1 <br />(13) also contain this exemption. <br />Division of Minerals & Geology (Staff for the Mined Land Reclamation <br />Board) has notified the petitioner that surface disturbances conducted <br />under the exemption to the definition of "exploration" may be a vlolatio; ~. of <br />the Mined Lend Reclamation Act unless the required notice of intent, fee, <br />reclan~atlon plan, and financial warranty are properly filed with the <br />Divisl~:•n before exploration ectivlty. <br />REQI~ cST FOR DECLARATORY ORDER <br />The petitioner is requesting a Board Declaratory Order to allow minor <br />surfecA disturbances within the scope of .the Rule 1.1(19) exemption to <br />
