Incompliance with applicable regulatory requirements
and pernut commitments, the required annual Professional Engineers certification for pond inspections is
provided in conjunction with the 2"d Quarter Inspection Reports.
As we discussed, we are in the process of transferring inspection responsibilities to Northwest Colorado
Consultants (NWCC), who will be providing inspection services and handling the required reporting and
certifications in the future. In conjunction with this transition, we anticipate that the annual certification
will be provided during either the 3~ or 4`s quarter. Please feel free to contact me with any questions.
Best regards,
For
Cc: dear~e Patterson/EFCI Southfield
Jim Mossman/Kerr Coal Company
Brian Len/NWCC
