Case No. W-1186-77 grants a
change of use to industrial, commercial, and mining for 577/937ths of the
Eckman Park rights and also grants an alternate point for storage. Water
Court Decree 79CW132 appears to grant the same alternate point of storage for
the remaining 360/937ths of the rights but did not change the use from
irrigation. It appears that this alternate point for storage described iri
both decrees is the same location as Sedimentation Pond A. As long as these
water rights are used and operated as described in these decrees and in
accordance with the priority system as directed by the Division Engineer in
Steamboat Springs, we see no problems.
Our other comments in the letter dated April 5, 1988 are still applicable.
Sincerely,
Hal D.
