On September 24, 2004 the Division received a reconsideration request from the Applicant. <br />As of January 11, 2005, the Division had received an acceptable performance warranty, <br />financial warranties in the amount of $145,500 and proof that all requisite public notice <br />procedures had been complied with for reconsideration of the permit application. <br />The Division has reviewed the record in this matter and recommends that the Board approve <br />the Applicant's request for reconsideration. Because the Applicant has posted the requisite <br />reclamation bond and has otherwise complied, in a timely manner, with all applicable public <br />notice requirements for reconsideration, it is appropriate for the Board to approve the <br />Applicant's Section 112 Reclamation Permit application. <br />ORDER <br />Based on the foregoing fmdings of fact and conclusions of law, the Boazd orders that the <br />Applicant's Section 1 I2 Reclamation Permit application is hereby approved. <br />DATEDthis ~~~ day of ~~~. >zoos. <br />FOR THE COLORADO MINED LAND RECLAMATION BOARD <br />Michael T.
