The Permittee, Geroux Gravel desires to conduct a mining operation (mown as Geroux Gravel, <br />for the purpose of e#racting Sand and gravel and borrow material for carstrudion. The Pennittee will not mine <br />any secondary commodities. <br />B. On October 23, 2000 the Mined Land Reclamation Board (the "Board") approved the <br />Permittee's application for this pemlit, fixed the amount of the financial warranty and directed that this permit be <br />issued upon the filing with the Division of Murerals and Geology (the "Division") of performance warranty and <br />financial warranty (or warranties) m the amour so fixed m form and substance approved by the Division. Said <br />warranties have bear Sled wrtlr the Division. <br />C. If the Pemrittee desires to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On October 23, 2000 the Board made the followurg findings: <br />1. The apphcation for this permit complies with the requirements of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Carstructiw Materials, C.RS. 34-32.5-101 et sue., as amarded, and <br />with all apphcable local, state and fijderal laws; <br />2. The operation will not adversely affect the stability of any significant, valuable, and <br />pemrarrart man-made structure located wither two hundred fleet of the Affected Land, except where there is an <br />agrearrart between the Operator and the persons havrsrg an interest m the structure that damage iv the structure is <br />to be wrr~ensated for by the Pemriftce; and; <br />
