Effluent Limitations: T&e data shown in the preceding tables indicate apparem violations of the permits. There were <br />jour instances of exceedences of both the 30-day average and daily maximum limitations for TSS and one esceedence <br />of both the 30day average and daily maximum limitations (during the second quarter of 1996) for total iron. The <br />first, during the second quarter of 1995, was caused by failure of a sump pump in the portal causing overflow of water <br />that traveled down a road and picked up additional solids. The second, during the second quarter of 1996, resulted <br />from an operator lowering a pump too law in a sump where it picked up settled solids. The third, during the fourth <br />quaver of 1996, was caused when an operator washed approximately 500 pounds of coal fines off a conveyor belt to <br />comply with OSHA requirements. These fines are normally removed dry and kept from the water systems. The fourth, <br />during the first quaver of 1997, was the result of unintentional overflow of the main sump. Each problem was <br />rectified as soon as it was discovered. No enforcemem actions were issued by the Division for any ojthese <br />exceedences. <br />2. Other Permit Reggiremems: The perminee has been in apparem compliance with all other terms and conditions of the <br />permit. <br />V!. TERMS AND CONDITIONS OF PERMIT <br />A. Determination of Effluent Limitations <br />I. Ej(Luent Limitations: In developing suitable effluem limitations, the Division must review all applicable standards and <br />regulations and apply those which are more stringem. Ibis review includes, but is vat limited to: the water quality <br />standard based e~lrtent limitations, federal guidelines and standards (40 CFR Subchapter M and State Effluent <br />Regulations (S CCR 1002-62). Such a review has been done jar this facility.
