Burden of Proof Requirements <br />The permittee has the btuden of proof when requesting relief from total suspended solids (TSS), total iron and/or settleable <br />solids primary limitations. Relief shall be granted only when necessary and shall not be granted when the permittee has <br />control over the discharge. The petmittee should endeavor to meet the primary limitations whenever possible. The <br />Division shall have final authority in determining whether relief is granted. Discharges from outfalls 005, 006, 007, 008, <br />009, 010, 011, 012, 013 and 014 aze eligible for this exemption. Outfalls 001, 002, 004 and 015 are not eligible. <br />a For rainfall, to waive TSS and total iron litnita[ions, it is necessary to demonstrate that dischazge occurred within 48 <br />hours after measurable precipitation has stopped. To waive settleable solids limitations, it is necessary to prove that <br />dischazge occurred within 48 hotus after precipitation greater than the 10-yeaz, 24-hour event has stopped. <br />Dischageg L'mi~a~ <br />See Part I.C. for Definitions. <br />
