Rationale -Page /1, Permit No. CO-0027146 <br />5) Surface Runoff Only: The discharges from outfalls 005, 006, 007, 008, 009, 010, 011, 012, 013 and 014 <br />comain surface runoff solely and are not believed to comain toxic polhaams rn toxic amounts nor do they <br />discharge during low flow periods. On this basis, WET testing is not a requirement for these outfalls. <br />However, the Division reserves the right to reopen the permit to include WET testing iffaciliry conditions <br />change or new injormaton becomes available. <br />4. Stormwater Evaluation: Stormwater from active and iwctive coal mining sites that has been contaminated by coNact <br />with overburden, raw material, intermediate products, byproducts, finished products or waste products located at the <br />site is requited to be covered by a Colorado Discharge Permit System (COPS) permit in order to be discharged to <br />Waters of the State. This coverage may be obtained under either a COPS /ndustria! Wastewater Discharge Permit ar <br />a COPS Slormwater Discharge Permit. <br />Division records indicate that Powderhorn Coal Company has coverage for stormwater discharges from the Roadside <br />Mine under a Genera! Stormwater Discharge Permit for stormwater discharges associated with metal mining <br />activities, number COR-040175. Stormwater permitting issues for this facility will be handled separately by the <br />Division's Stormwater Unit, although this permit may be reopened at a later date to incorporate stormwater <br />provisions, if deemed appropriate. <br />5. Economic Reasonableness Evaluation: Section 25-8-503(8) of the revised (June 1985) Colorado Water Oualirv <br />Control Act required the Division to "determine whether or not any or all of the water quality standard bated eJJluem <br />limitations are reasonably related to the economic, environmental, public health and energy impacts to the public and <br />affected persons, and are in furtherance of the policies set forth in sections 25-8-192 and 25-8-104. " <br />The Regulations for the State Discharge Permit System, S CCR 1002-67.0, Jurther define this requiremem under <br />section 61.12.0 and state: "Where economic, environmemal, public health and energy impacts to the public and <br />affected persons have been considered in the classifications and standards setting process, permits written to meet the <br />standards may be presumed to have taken into consideration economic factors unless: <br />a) Anew permit is issued where the discharge was not in existence at the time of the classification and standards <br />rrtlemaking, or <br />b) /n the case of a continuing discharge, additional information or factors have emerged that were not anriciprued or <br />considered at the time of the classification and standards rulemaking. " <br />Furthermore, this is not a new discharger and no new information has been presented regarding the classifications <br />and standards. Therefore, the water quality standard-based effluent limitations of this permit are determined to be <br />reasonably related to the economic, envirorunemal, public health and energy impacts to the public and aJjected <br />persons and are in furtherance of the policies set fonh in Sections 25-8-102 and 104. If the permittee disagrees with <br />this finding, pursuant ro 61.12.0(1) (b) the permittee should submit all pertinem information to the Division during the <br />public notice period. <br />B.
