(WI) recently obtained authorization from the U.S. Army Corps of
. Engineers for a low water crossing of Boulder Creek to be constructed as part of Asphalt
Specialties proposed Turnpike Mining Resource gravel mining operation in Weld
County, Colorado. The Corps authorized the construction under Nationwide Permit No.
14, contingent on obtaining threatened and endangered species clearance from the U.S.
Fish and Wildlife Service (USFWS). The purpose of this letter is to request confirmation
that the results of a previous Preble's meadow jumping mouse (PMJM) survey performed
in the project area are still valid. This letter addresses clearance for PMJM. WI will
'address Spiranthes diltJVialis clearance in a sepazate letter.
Project Location
The project area is in Section 31 T2N R68 W (Figure 1) and can be found on the USGS
Erie, Colorado 7.5 minute topographic quadrangle. The proposed mining activity will
- take place in the north %z of the section. The project borders State Highway 52 on the
south and County Line Street, which separates Boulder and Weld Counties, on the west.
Previous PbIJbI Survey
ERO Resources (2000) performed a PMJM trapping survey on the project area in 2000.
They did not find any PMJM present. ERO submitted their findings to the USFWS in a
report dated June 30, 2000. The USFWS concluded that PMJM "is not likely to be
present within the subject area" in a letter dated August 8, 2000.
Cturent site conditions are the same as those described in ERO's 2000 report. Based on a
recent conversation with you (Plage, 2004), I believe that no PMJM have been found on
or neaz Boulder Creek in the vicinity of the project area, that the results of the ERO
survey aze still valid, and that additional surveys need not be performed at this time. WI
would appreciate written confirmation of the current validity of the clearance granted in
2000.
' ~ ID3_95 CaJfax Ave.. Suite 350.
