Mr. Thomas Schreiner
July 29, 2003
the shiny wall included in this submittal. We have revised the Reclamation Cost Estimate and
enclosed for your review.
6.4.14 EXHIBIT N - Source of Legal Right to Enter
24. As described on page 1 of this letter, the updated legal description for the permit boundary is
enclosed for your reference. The mining permit boundary encompasses all of the property
described as: °A parcel of land being all that part of the SE'/,and part of the E'l: SW Y. of
Section 12, Township 5 North, Range 65 West of the 6'h P.M., County of Weld, State of
Colorado.° And a portion of the property described as: "Lot B of Corrected Lot B of 2nd
Amended Recorded Exemption No. 0961-12-4-RE1053, recorded July 11, 2001 as Reception
No. 2864757, being a part of the SE'/. of Section 12, Township 5 North, Range 65 West of the
6rh P.M., County of Weld, State of Colorado.'
Both parcels are owned by Water Resources, LLC and the legal right to enter included in the
application gives Hall-Irvvin Corporation the right to enter into both parcels.
25. Our response to this item will be submitted within the week.
6A.19 EXHIBIT S -Permanent Man•Made Structures
26. The Stability Analysis originally submitted is a conservative analysis based on the use of
conservative strength parameters in the modeled profile and is consistent with analysis
requests made by DMG personnel on past submittals. Due to the conservative strength
parameters utilized in the analysis, the factor of safety generated should be acceptable and
provide reasonable assurances that nearby structures will not be harmed by site mining
activities.
King Surveyors provided the base map for this project The survey map designated
°approximate° on the underground utility locations. The pipes are shown within the legal
easements, or as surveyed by pipe location markers provided by the utility companies. The
language on the Mining Plan states that the setbacks are based on the stability analysis
requirements, and that all underground utilfies shall be located prior to mining. This note
ensures the setback requirements will be satisfied should the exact location of the pipes vary
and should the slurry wall location need to be adjusted during final design.
27. Please refer to item 7 on page 2 of this letter. We have also enclosed the Oil and Gas
Facilities - Existing Conditions, Mining and Reclamation Plans for your reference.
28. Based on the regulations, Hall-Irwin submitted a Stability Analysis to satisfy the requirements
of 6.4.19; therefore notarized structure agreements are not required.
29. As required by Rule 1.8.1, this letter and enclosures will be submitted to the Weld County Clerk
to the Board of County Commissioners office. A signed affidavit from the Clerk's office will be
forwarded via fax to the Division.
