P.O: Box 953 /21215 Highway 52 Fort Morgan, Colorado 80701 RE: Westhoff Pit Our File !77-94 Dear Sirs: As you know, your application fora mining and reclamation permit Is scheduled to be presented to the Mined Land Rnclanuttlon Board at the July 25-26, 1979 meeting. At this time, I have yet to receive your response to our review comments about your permit application. Because of the short period of tinro before the Board meeting, It would be difficult to complete our review even If you were to submit the material requested before July 25, 1979. Thus, at this tdme your permit application must be deemed not adequate and the staff cannot reconniand approval of the application at the July meeting of the Board. Our records show ttrt the permit application process began in June, 1977, Subsequently. letters were sent by our staff on April 6, 1978 to Morgan Sand and Gravel Co. and on November 2, 1974 to Mr. George Raddin, your attorney, offering assistance in completing the permit process for the Morgan Sand 6 Gravel operation. The November 2, 1979 letter also cautioned the operator about the consequences of operating without a permit. On Jan 25, 1979 an epplicatlon that could be reviewed for completeness was received by this office. An Incom- plete latter was sent to you on Jan 26, 1979. Your response to the staff's Incomplete letter was received on April 25, 1979. The staff then sent Yycamplete letter on April 27, 1979. An adequacy letter was sent by the staff on May 22, 1979. Up until nas there has been no further correspondence. It Is evident that a considerable anaunt of time has lapsed between the initial application and wheaew~esstand today.
