We have no record that you have applied for or obtained a stormwater <br />permit for the above-referenced operation. (This letter does not apply to any discharges authorized <br />under your individual CDPS permit, CO-0027146.) <br />In 1987, the US Congress amended the Clean Water Act to expressly include stormwater discharges <br />from industrial sites as requiring Clean Water Act controls. In 1990, EPA issued regulations that <br />require specific industrial activities to obtain permits in order to discharge stormwater from their <br />facilities. Coal mining operations are specifically included. -' <br />The Water Quality Control Division of the Colorado Department of Public Health and Environment <br />has direction and authority to administer the stormwater permit program in Colorado. <br />The Division has issued general permits for the regulated industrial activities. An application form <br />for the General Permit for Stormwater Discharges from Metal Mining (which also covers coal <br />mines) has been enclosed for your use. Please complete the application and submit it to our office. <br />by August 14, 1995. <br />Note that the application must include certification of completion of a Stormwater Management Plan <br />(SWMP), and that the SWMP must be fully implemented by the time the permit is issued.
