We have no record that you have applied for or obtained a stormwater
permit for the above-referenced operation. (This letter does not apply to any discharges authorized
under your individual CDPS permit, CO-0027146.)
In 1987, the US Congress amended the Clean Water Act to expressly include stormwater discharges
from industrial sites as requiring Clean Water Act controls. In 1990, EPA issued regulations that
require specific industrial activities to obtain permits in order to discharge stormwater from their
facilities. Coal mining operations are specifically included. -'
The Water Quality Control Division of the Colorado Department of Public Health and Environment
has direction and authority to administer the stormwater permit program in Colorado.
The Division has issued general permits for the regulated industrial activities. An application form
for the General Permit for Stormwater Discharges from Metal Mining (which also covers coal
mines) has been enclosed for your use. Please complete the application and submit it to our office.
by August 14, 1995.
Note that the application must include certification of completion of a Stormwater Management Plan
(SWMP), and that the SWMP must be fully implemented by the time the permit is issued. I have
included a copy of our guidance document for SWMP preparation, as well as a fact sheet describing
the Stormwater program.
CERTIFIED NO: z 416 9 6 8 7, 3 2
