<br />• (H) A description of all threatened and endangered <br />species and their critical habitats located within the affected area of the <br />proposed surface coal mining and reclamation operations. <br />RESPONSE: <br />These subsections have been adequately addressed in the permit applica- <br />tion package responses to Rule 2.04.11, Fish and Wildlife Resources <br />Information, and Rule 2.05.6(2), Fish and Wildlife Plan. <br />4) Where the surface of the Federal lands is sub.iect to a lease or <br />permit issued by the Federal government to a person other than the applicant, <br />the permit application package shall contain information sufficient to <br />demonstrate compliance with the requirements of 740.15(c)(1). This <br />requirement shall not apply to TVA-owned lands. <br />RESPONSE: <br />This subsection is not applicable to the planned mining and reclamation <br />operations. Information on leased federal surface lands is addressed in <br />the permit application package response to Rule 2.03.6, Right of Entry <br />and Operation Information, and Rule 2.10.3(1)(a), Specific Information <br />Requirements. <br />• <br />Ex. 1-5 <br />
