This should not be <br />construed ea meaning duplication of a <br />per:rtit application in a permit <br />application package under SMCRA. The <br />resource recovery and protection plan <br />may cross-reference. as appropriate, a <br />permit application submitted under <br />SMCRA to fulfill this requirement. <br />(6) Any required data which are <br />clearly duplicated in other submittals to <br />the regulatory authority or Mine Safety <br />and Health Administration may be used <br />to fulfill the requirements of the above <br />paragraphs provided that the crosr <br />reference is clearly stated. A copy of the <br />relevant portion of gush submittals must <br />be included is the resource recovery and <br />protection plan. <br />(i) Explanation of how MER of the <br />Federal coal will be achieved far the <br />Federal coal leases included in the <br />resource recovery and protection plan. It <br />a coal bed, or portion thereof, is not to <br />be mined or is to be rendered unminable <br />by the operation, the operator/lessee <br />shall submit appropriate justification to <br />the authorized officer for approval. <br />§3182.2 Aetioo 0o plan. <br />(a)(I) Espforarion plans. The autho- <br />rued afAeer after evaluating a proposed <br />exploration plan and all commenu re- <br />ceived [hereon, and after consultation with <br />the responsible officer of the surface man- <br />aging agency, and with the regulatory au- <br />thority when exploration is to be conduct- <br />ed within an approved permit area prior to <br />commencement of mining operations, shall <br />promptly approve or disapprove in writing <br />an exploration plan. In approving an ex- <br />ploration plan, the authorized officer shall <br />determine tha[ the exploration plan com- <br />plies with the rules of this Part, applicable <br />requiremenu of 30 CFR 815.15 or an <br />approved Stale program, and any Federal <br />lease or license terms andJor conditions. <br />Reclamation must be accomplished as set <br />forth in the exploration plan. The autho- <br />rued officer may impose additional condi- <br />tions to conform to the rules of this Part. <br />In disapproving an exploration plan, the <br />authorized officer shall slate what modifi- <br />ca[ions, if any, a« neceuary to achieve <br />such conformity. No exploration plan shall <br />be approved unless the bond, executed <br />pursuant to the provisions of 43 CFR 3474 <br />or 43 CFR 3410, haz been determined by <br />the responsible officer of the surface man- <br />aging agency to be adequate. When the <br />land involved in the exploration plan is <br />under [he surface management jurisdic- <br />tion of an agency other than DOI, that <br />other agency must concur with the ap• <br />proval teems of the exploration plan. <br />(2) Resource reiavery and protection <br />ploys. No resource recovery and <br />protection plan ar modification thereto <br />sh:dl be approved which is not in <br />conformance with the rules o(this Part. <br />any Federal lease or license terms :md/ <br />or conditions, and is not found to <br />acL•ieve MER of the Federal cord within <br />an LMU or Feoeral (ease issued or <br />readjusted after August 4.79:6. The <br />determination nF MER shall be made by <br />the authorized officer based on review of <br />the rt~ource recovery and protection plan. <br />No resourtt recovery and protection plan <br />shall be approved prior to the filing of a <br />wmplete permit application package and <br />unless the Federal lease bond, executed <br />pursuant to the provisions of 43 CFR 3474 <br />has been determined by the authorized <br />officer to be ada.uate. <br />(3) Recovrruble coal reserves esri- <br />mares. For all Federal coal leases issued ar <br />readjusted after August s, 1976, the re- <br />coverable coal reserves or LMU «cover- <br />able coal reserve, .shall be those estimated <br />by the authorizes officer as of the date of <br />approval of the r:source recovery and pro- <br />section plan, or the date of approval of any <br />existing mining plan as defined at 30 CFR <br />740.5 (1981). [f an operator/lessee credits <br />production toward diligent development in <br />accordance with §?483.5 of this title, such <br />credits shall be included in the «coverable <br />coal reserves or LMU recoverable coal <br />rexrves estimates. The u[imate of recov- <br />erable coal rexrva or LMU recoverable <br />coal reserves may only by revised az new <br />information bewmes available. Estimates <br />of recoverable coal reserves or LMU re- <br />coverable coal reserves shall not be re- <br />duced due to any production after [he <br />original estiamte made by the authorized <br />officer. <br />[211.11(a)(3) [3482.2(a)(3)j coy«cted by <br />47 FR 53365. Novembec 26, 1982) <br />(b) Changes in plans 6y Authorized <br />Officer. (l) Approved exploration plans <br />may be required to be revised or supple- <br />mented a[ any time by the authorized <br />officer, after consultation with the opera- <br />tor/lessee and the responsible of5cer of <br />the surface managing agency as necessary, <br />to adjust [o changed conditions. to correc[ <br />oversights, or to reflect changes in legal <br />requirements. <br />(2) The authorized officer pursuant [o <br />MLA, may require approved resource re- <br />covery and protettion plans to be revised <br />or supplemented reasonably for modifica- <br />tion. after consultation with the operator <br />lessee and the regulatory authority as nec- <br />essary, to adjust to changed conditions, to <br />corrcet oversights, or to reflect changes in <br />legal requirements. Such revisions shall be <br />made in writing, as appropriate, and the <br />authorized officer, shall submit a copy to <br />the regulatory authority. <br />(rl Changes in p/nns by o/~crnmri <br />/essce. (1J The opera for/lessee may <br />propose modifications to an approved <br />e:,ploration plan and shall suhmil a <br />written statement of the proposed <br />change and iu justification to the author- <br />ized ofHar. The authorized officer shall <br />promptly approve or disapprove in writing <br />any such modifications, after consultation <br />with the responsible officer of the surface <br />managing agency and [he regulatory au- <br />thority as necessary, or specify wnditions <br />under which [hey would b< acceptable. <br />(21 The operator/lessee may propose <br />modifications Io an approved resottrre <br />recovery and protection plan (or any <br />requirements under MLA. and shall <br />submit a written statement of :hr. <br />proposed change and its justification to <br />the authorized officer. The authorized of <br />fiver shall promptly approve or disapprove <br />in writing any such modifications, after <br />wnsultation with the regulatory authority <br />az necessary, or specify conditions under <br />which they would be acceptable. Upon <br />approval of modifications, the authorized <br />officer shall submit a copy to the regula- <br />tory authority. <br />§31813 Mitdt[g operadore maps. <br />(a) Genera! requircmenrs.
