Yaklich <br />1120 County Road 129 <br />Westcliffe, CO 81252 <br />Re: File No. M-89-024, Shangri La Pit, Complete Application <br />Dear Mr. and Mrs. Yalclich: <br />We have received your application for a 14ining & Reclamation Permit for your <br />surface mining operation in Custer County. Our initial review indicates that <br />all preliminary items required by the Colorado Mined Land Reclamation Act, <br />C.R.S. 34-32-101, et seq., have been submitted; thus your application has been <br />deemed complete. AT1 comment and review time periods initiate from this date. <br />The tentative date for consideration of your application is April 17, 1989. <br />You should commence publication of a notice of the filing of this application <br />immediately lsee enclosed notice format). You must also mail a copy of the <br />notice 'to all owners of record of surface rights of affected land and <br />immedia~:ely adjacent land. You must provide proof of the notice and mailing, <br />such as Certified h1ai1 Return Receipt Requested, to the MLR staff before your <br />application can be considered. You must also place a copy of this application <br />for public review, less confidential items, with the Custer County Clerk and <br />Recorder. Any subsequent changes or additions to the copies on file in our <br />offices must also be made in this local government copy. <br />I have reviewed the application to determine whether it is adequate to meet <br />the requirements of the Act and Regulations. The list below details items <br />which need clarification before the application will satisfy the applicable <br />requirements. Please provide a response to each item prior to April 10, 1989. <br />Although you propose to include a pond as a central feature in your <br />past-mining land use scheme, you conclude that there will be "no <br />appreciable injury to existing water rights" and that "any loss due <br />to evaporation would be miniscule". We recommend that you contact <br />the Division of Water Resources and/or a consulting water engineer <br />concerning water rights issues pertinent to creation of a pond, as <br />it is probable that you will have to get approval of a Plan for <br />Augmentation for this site.
