Box 535 <br />Somerset, CO 81434 <br />Re: Emergency Mine Dewatering, Oxbow Mining, Inc., <br />The Sanbom Creek Mine, Permit No. C-81-022 <br />Dear Ms. Welt: <br />It is our understanding that Oxbow Mining, Inc. has yet to reopen the Sanborn Creek Mine. We also <br />understand that the level of the water in this underground mine is rising, and will reach the longwall <br />equipment currently left in the mine in a matter of days. We further understand that Oxbow Mining is <br />considering pumping this water out of the mine, and discharging it via a discharge point that is <br />currently not approved by either our Division or the Colorado Depaztment of Public Health and <br />Environment's Water Quality Control Division. <br />Should Oxbow decide [o proceed with this activity, we request that Oxbow submit an application for a <br />revision to its DMG permit to address this activity. We also request that this revision contain a copy of <br />the written approval for this activity from the Colorado Water Quality Control Division. Please do not <br />pump water out of The Sanbom Creek Mine via any unapproved discharge point until Oxbow Mining, <br />Inc. has received approval for this activity from both our Division and the Colorado Water Quality <br />Control Division.
