Rockcastle has submitted an application and relevant supporting documentation
to the Colorado Division of Minerals and Geology (DOMG)_reguesting_fmal_bond releaze for
the Grassy Creek site. Recent conversations with DOMG Staff indicate that Rockcastle has
complied with all appliable regulatory provisions for final bond release and that final release
is anttctpated during May or early June.
The current CDPS Permit (Permit No. COG850023) addresses control and monitoring of
effluent discharge for the following discharge points:
001 -Pit 4 Sedimentation Pond Outlet
002 -Pit 3 Sedimentation Pond Outlet
003 -Pit 2 Sedimentation Pond Outlet
004 -Pit 1 Sedimentation Pond Outlet
005 -Pits 5/6 Sedimentation Pond Outlet
In conjunction with final site reclamation, the sedimentation ponds for the Pits 1, 2, and 3 areas
have been removed and azsociated disturbance areas reclaimed, so Discharge Points 002 003, and
004 no longer exist. In addition, the sedimentation ponds for the Pit 4 and 5/6 areas ~tave been
modified to meet USDA-SCS and Colorado Division of Water Resources requirements az stock
tanks or non-jurisdictional storage reservoirs.
Contributing drainage areas have been effettively reclaimed equivalency of premining and
postmining sediment contributions has been documen[ed, and DOMG is proceeding with the
necessary actions for final bond releaze. Rockastle is, therefore, seeking Water Quality Control
Division approval to discontinue monitoring and reporting attivities under Permit COG850023
and retire the permit.
Please provide any necessary forms and/or instructions for termination of CDPS permit
responsibilities. Thank you for your assistance in this matter.
Sincerely,
ACZ Inc.
Jer G&(Iy>~tleton
JMN: c
cc: K. Gorham/DOMG
J. Chubrilo/Division of Water Resources
D.
