Canany <br />Division DIICC1of <br />Natural Resource Trustee <br />RE: Termination of Requirement to Conduct Seep Monitoring Below S-Shaft, Permit No._M-1977-493 r~ <br />Dear Mr. Romig: <br />On Apri12, 2003, Climax submitted a request to the Division of Minerals and Geology (DMG) to <br />discontinue seep monitoring below S-Shaft located in the Storke Yard at the Climax Mine. Climax has <br />conducted this monitoring annually since 1995; the monitoring requirement was established to determine if <br />springs or seeps would develop as a result flooding the underground workings of the mine. <br />The DMG inspected the monitored azea on September 29, 2004; based on observations made during that <br />inspection and on the annual reports of the monitoring conducted by Climax, DMG concurs that flooding of <br />the workings has not resulted in seepage of mine water to the surface in the monitored area. DMG hereby <br />releases Climax from the obligation for any continued 5-shaft seep monitoring. DMG will continue to <br />require monthly monitoring and annual reporting of water elevations in 5-Shaft and in the 5-Shaft <br />Monitoring Well. <br />If you have any questions, please contact me at 303-866-4063. <br />Sincerely, <br />Allen C.
