An examination of the report of my March 18, 1986 inspection of the Oakleaf
Pit will indicate that, in my estimation, the disturbed area was in excess of
the permitted 9.92 acres. I have enclosed a copy of this inspection report
for your information. On April 30, 1986, Bruce Cramb responded to my report.
A reading of his letter indicates that, if the disturbed area in the buffer
zone between the pit and the river is included (as it must be), the disturbed
area may indeed exceed the permitted acreage. To date, this problem has not
been corrected.
In the aforementioned letter from Mr. Cramb to me, he indicated that both the
performance and financial warranties for the 112 permit for this same site
(i.e., the Pueblo East Pit) would be submitted within two weeks of permit
application approval, thereby correcting the problem described above. The 112
application was approved on April 24, 1986, and to date, no warranties have
been submitted. In order for the Pueblo East Pit permit to be issued, a
performance warranty and a $30,850.00 financial warranty must be submitted to
us.
Please submit the performance and financial warranties for the Pueblo East Pit
at your earliest convenience. In this way, the permit for the Pueblo East Pit
can be issued. If we do not received an adequate warranty package by
