OMAHA DISTRICT <br />TRI-LIKES PROJECT OFFICE. 9307 STATE HWV 121 <br />LITTLETON, COLORADO 80123-8901 <br />ATTMgN OF <br />"`~LY7D March 31, 1994 <br />Erik Olgeirson <br />4440 Tule Lake Dr. <br />Littleton, Colorado 80123 <br />Dear Mr. Olgeirson: <br />Reference is made on behalf of ECC Construction Material Inc., which is located in <br />Section 16, Township-2-North, Range-69-West, Boulder County, Colorado. <br />Your project has been reviewed in accordance with Section 404 of the Clean Water Act <br />_ under which the U.S. Army Corps of Engineers regulates the excavation and discharge of <br />dredged and fill material into waters of the United States including wetlands. <br />This letter is to inform you that the wetland delineation March 1994 is considered <br />accurate and acceptable by this office. The wetlands are considered to be waters of the United <br />States pursuant to Section 404 of the Clean Water Act. If a proposod activity requires work <br />within these waters, this office should be contacted for proper Department of the Army permits. <br />This wetlands jurisdictional delineation is valid for a period of three years from the date <br />of this letter unless new information warrants revision of the delineation before the expiration <br />date. <br />Please be advised that the U.S. Fish and Wildlife Service (iTSFWS) has determined that <br />the Ute ladies' tresses orchid, SR-~S ~yj~ig, may occur in seasonally moist soils and wet <br />meadows near springs, Likes, or perennial streams and their associated flood plains below 6,500 <br />fcet elevation in certain areas in Colorado. This plant species is now officially listed as <br />threatened under the Endangered Species Act. For projects in specific areas, a survey for this <br />plant species, approved by the USFWS, will be required before the Corps of Engineers can issue <br />authorization for work within waters of the United States.
