Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology (DMG) received your letter on January 9, 2004 regarding comments/objections <br />to the Lafazge Duckworth New 112 Application, File M-2003-091. <br />A copy of the notice, mailed to the Town Mayor of Frederick on November 17, 2003, concerning the Duckworth permit <br />application is enclosed. The notice specifies that the comment period for the application was for a period of 20 days <br />following the newspaper publication regazding the application. The last day of publication for the application notice <br />was December 18, 2003. Therefore the comment period for the application closed on January 7, 2004, and your <br />objection to the application parameters was received after closing of the comment period. As a result, the Division <br />cannot consider your objections to the Duckworth New Application. The Division does concur with the Town of <br />Frederick regarding concerns over the seed mixture and rate of seeding proposed by Lafazge. Your concerns were <br />noted in the Division's adequacy letter of January 16, 2004. However, the remaining items aze not within the <br />jurisdiction of the Division. <br />The Town of Frederick has the right to appeal the Division's decision before the Mined Land Reclamation Boazd <br />regarding party status under Rule 2.6 of the Construction Materials Rules and Regulations.
